These Terms are governed by the laws of China, except for the United States of America, to which the laws of China apply.
Force Majeure
We shall not be liable for any failure or delay in the performance of any of our obligations under the Contract as a result of an event of force majeure. An event of force majeure means any act or event beyond our reasonable control, such as, but not limited to, third party strikes or industrial action (but not caused by Meekin Group’s own employees), civil commotion, riot, invasion, terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic, pandemic or other natural disaster (“Event”).
If an Event occurs that affects our performance of our contractual obligations:
(a) we will contact you as soon as possible to notify you; and
(b) our obligations under the Contract will be suspended and the time for us to perform our obligations will be extended for the duration of the Event. If the event affects our delivery of products to you, we will arrange a new delivery date with you after the event.
You may cancel the contract affected by the event. To cancel, please contact our customer service team. If you choose to cancel, you will have to return (at our expense) any related products you have received and we will refund the price you have paid, including any shipping charges.
Additional Terms
We may assign our rights and obligations under the contract to another organisation, but this will not affect your rights or our obligations under these terms.
You may only assign your rights or obligations under these Terms to another person if Meekin Group agrees in writing to do so.
These Terms are agreed upon by you and us. No other person has the right to enforce any of their terms.
Each provision of these Terms operates separately. If any provision is held to be unlawful or unenforceable by any court or appropriate authority, the remaining provisions will remain in full force and effect.
Meekin Group’s failure or delay in exercising any right, power or remedy provided under these Terms or available at law or in equity will not constitute a waiver by Meekin Group of the right to exercise any such or other right, power or remedy or require such compliance, or performance by you of your obligations under these Terms. If we do waive a breach, we will do so in writing on a case-by-case basis.
